Maryland Pension Exclusion

Client received RMDs from a Traditional IRA that should go on Maryland Worksheet 13A ‘Pension Exclusion Computation Worksheet.’  This is a Rollover IRA that qualifies, since every dollar came entirely from a 401(K).

The Rollover IRA Exception:

Starting in tax year 2022, Maryland passed a bill (Senate Bill 123) that allows a Rollover IRA to qualify for the pension exclusion, but only under a zero-tolerance condition: [1] The 100% Rule: Every single dollar in that Rollover IRA must have come entirely from an eligible "employee retirement system" (such as a 401(k), 403(b), or defined-benefit pension plan). [1]

However, there is no place in Lacerte to tell it that this is a Rollover IRA that qualifies. If I unclick the IRA box in the 1099-R input screen, that triggers the Maryland Worksheet 13A but then the IRS Form 8606 disappears, so this is not a solution.

What is the solution?

Hi @MD CPA great to see you in the Community and thanks for posting about the Maryland pension exclusion. We were unable to find a way in Lacerte to generate the Maryland Worksheet 13A treatment without impacting Form 8606. The next step would be to submit a Calculation Challenge for Lacerte. You can find instructions for submitting it here.

This will allow the appropriate team to review the calculation and your supporting documentation to determine whether a program change may be needed

If you need additional assistance with the process, please reconnect with Lacerte Support.

I already called Lacerte Support. They could not find a solution and suggested that I write my question here in this community.

Do you have evidence that bill became law? I practice in MD and was not familiar with it (but that doesn’t mean anything). My quick CoCounsel search says it did not become law. “it remained in the Senate with a hearing in Senate Budget and Taxation and was not enacted.”

The more I know the more I don’t know.

Upon much further research - you are correct!

“Legislators have repeatedly tried to fix this specific "rollover trap," but the bills have routinely stalled in committee or failed to clear both chambers due to the projected loss in state tax revenue.”

    Thank you for your comment!
