The following diagnostic is generating: A maximum of one Form 8853 is allowed for e-file returns. My client has 2 long-term care contract distributions. This comes up as a critical diagnostic. Publication 1345, 1436 does not mention this form. Publication 4164 indicates only 1 Form 8853 is allowed for a 1040-NR, but does not mention a 1040.

    The IRS efile schema only allows one 8853 to be included in the efile whether that efile is for a Form 1040 or a Form 1040NR.  This return will need to be filed as a conventional paper return
