2023 taxpayer had simple side job W-2 that the employer never correctly sent to SS. The IRS denied the $1800 withholding. We jumped through all the hoops and eventually went to TAS where they didn't resolve the issue.
Suggestions?
What do you think about this: IRS clearly recognized the income but not the withholding. What if I file an amended return just amending the withholding amount and including a copy of the W-2? Hate to muddy the waters but they are not helping.
Or, ?
Thanks.
TAS is a public relations arm of IRS that is even less effective now that its staffing has been seriously reduced. However, they are good at writing memos. This sounds like the taxpayer received a "math error notice," and didn't request abatement within 60 days. TAS has a memo for that. It doesn't say, "bring us the problem."
Are there pay stubs? Maybe a discussion with Social Security (I know staffing issues) might be in order to be sure SS quarters are recorded.
It was a claim of Partial Disallowance. We did meet all the timelines but IRS kept extending theirs till over a year. We did send in the paystubs that matched the W-2.
The SS department did not have this W-2 recorded and the Payer said they corrected that by filing. We haven't checked to see if done.
Did get a letter from TAS stating successfully resolved and closed the case. It said IRS will correspond with details. That has not happened.
So you have a correct W-2 now? That you did not have when the return was filed? I would file (paper) an amended return with all the documents that show withholding, and wait six months for a refund with 8% interest.
The W-2 was always correct. The employer just never sent their copies to SS.
