My client is claiming her 2 kids however her ex paid for their insurance through the Marketplace. Her return rejected, the error states that the e-File database indicates that Form 8962 or a binary attachment with the description containing "ACA Explanation" must be present in the return. The IRS internal database indicates that a Form 1095-A should have been received by the taxpayer.

How do I handle this?

You may get it accepted by adding the ACA explanation statement, but be prepared for an IRS letter requiring the 8962 before her return can complete processing.   

She'll need to ask the ex for a copy of the 1095A, if he took the 100% allocation, she can allocate 0% on her return, but she'll still need to provide the 8962 to IRS showing this 0% allocation.
