I have a client who has gambling winnings reported on 1099-Misc as other income.
He has losses but the losses can not be taken because it was reported on a 1099-MISC as other income. Is there somewhere else I can report the gambling losses to net out the winnings?
Sounds like he won a prize or an award, not gambling winnings, gambling is reported in a W2G.
The 1099-Misc is from Gila River Gaming Enterprises, Inc. & he has receipts to show his losses.
I have never seen gambling winnings on a 1099-Misc form.
You could put them on schedule A if he itemizes up to the amount of winnings
sounds like it was winning a drawing or raffle maybe, rather than a wager that resulted in gambling winnings.
I know our local casino gives out winnings just for being present and your player card gets drawn, thats not gambling winnings, thats a prize.
I agree, it does not sound like gambling winnings to me. I've always saw winnings on a W2G
The money won was sports betting on games. Is this not the same as gambling?
It gives me an error message when I put the amount in gambling losses and there is no other
way to put the losses in the tax return. Schedule A does not have a place where I can write it in as gambling losses.
I dont think you can force through gambling losses against a 1099MISC.
This wouldn't by chance by from fantasy sports activities, would it?
No he was betting on professional sports games at a casino.
Absolutely.
And how do you know it was from sports betting? Were you there with him? Many of these casinos and online gaming outfits offer incentives, like "first bet matched even if you lose." When all else fails, call the number on the 1099-MISC and ask them why it's not a W-2G. They may tell you that they are following the instructions for Box 3: "Also include amounts paid to a winner of a sweepstakes not involving a wager. If a wager is made, report the winnings on Form W-2G."
