Hi everyone, so I live in california and have mostly CA clients. I am used to seeing people with W2s for IHSS care provided in the home, and if they live with the person they are caring for they can exclude the income per notice 2014-7 medicaid waiver which is what im used to seeing often.. but I just came across someone who lives in Arizona and they sent me a "Declaration of Qualification" the letter states.. "I am a individual care provider and I receive payments from Arion Care Solutions that qualify as payments made under a state medical home and community based services waiver program for care i provide and that the services are rendered at the same dwelling as the patient" so is this also eligible for the exclusion of income just like ihss W2s that im used to seeing in California? Anyone have any experience or knowledge in this area for Arizona? Also my client never signed the form.. its blank it required her signature and the supervisor signature. I told her well to start off it must be completed and signed by both parties.. but in the meantime i told her i would look into this some more to make sure i can exclude it cause its kicking in a huge EIC credit. so i want to be super cautious and carefu for my due diligence.
"and that the services are rendered at the same dwelling as the patient"
Well, that sure doesn't meet the "live in/with" requirement. One of them needs to be living with the other.

"For purposes of this notice, qualified Medicaid waiver payments are payments made by a state or political subdivision thereof, or an entity that is a certified Medicaid provider, under a Medicaid waiver program to an individual care provider for nonmedical support services provided under a plan of care to an eligible individual (whether related or unrelated) living in the individual care provider’s home."
You can call it a duck, but if it doesn't quack, it's not a duck.
