BEFORE I SET ON, THANKS FOR ALL THE HELP.

MY CLIENT HAS A 19 YEAR OLD STUDENT WITHOUT 1098-T (HIS COLLEGE PORTAL IS NOT ISSUING IT). IF I MARK "S" ON DEPENDENT PART, CLINET CAN GET A REFUND. ANOTHER PERSON BROUGHT SOME PAPER FOR 2021 SOWING THAT IRS DEBITED HIM BECAUSE ON HIS RETURN THERE WAS NOT A 1098-T AND IRS ASKED HIM TO FILL OUT THE FORM 8862. NOW, I DO NOT WANT TO MAKE THE SAME MISTAKE FOR A NEW CLIENT. 

IN CONCLUTION: CAN I PUT "S" FOR DEPENDENT EVEN IF THE DEPENDENT DOES NOT HAVE A 1098-T?

HOW IRS UNDERSTAND THIS DEPENDENT IN FACT IS A STUDENT?

ANY HELP IS VERY WELCOME.

You can claim a 19yr old dependent using Student for EIC code without claiming education credits.  Totally possible that a 19yr old was just graduating high school. 

Did your other client receive an 8862 or 8863  - makes a difference.  

8862 is for claiming credits that a taxpayer was previously disallowed       

8863 is for claiming education credits

Thanks, I made for him 8862 and it is important to mention that IRS mentioned on its notice that we changed your refund that when I checked the only reason was for his daughter that did not have 1098-T.

His EITC WAS REMOVED AND IRS GAVE HIM ONLY $500 AS OTHER DEPENDENT.

SO, FOR MY OLD CLIENT WHO HAS A SON WITHOUT 1098-T, I PUT "S" FOR DEPENDENT PART BUT I THINK SAME PROBLEM MAY HAPPEN.
