Recovery rebate #3 question

fredr
Level 4

Married taxpayers with two dependents filed a joint return for 2020 tax year. They received EIP 3 for $5600.00 in March 2021. In May 2021 they got divorced. Spouse has custody of 2 children on 2021 tax return. Each taxpayer got letter from IRS saying that they got $2800.00 EIP 3.My question is when i put the $2800.00 on line13 of the recovery worksheet it’s giving taxpayer another $1400.00 because line 8 is $4200.00. Should she be getting another $1400.00?

The parent that is not claiming any children on 2021 will possibly have to pay back their portion of the ACTC..depends on their income.
