1120 or 1120S - based on EIN letter

Client's EIN letter says he must file Form 1120.  

Client believes he has an S-Corp.

How determinative is the EIN letter on which filing is required?

It's not, but neither is "Client believes he has an S-Corp".

He probably requested the EIN before he filed the 2553.  And then he might have forgotten he needed to do that also.  Have you asked him for a copy of it?

If it's an S corp, you're late.  If it's a C corp, you're not.

Make the client call the IRS and sit on hold.  It's not your job to babysit. They should know about their own company.
