Maryland Form 511

Hate1040s
Level 1

I originally filed some Form 510s earlier in 2021 for 2020 pass-throughs.

I read the Maryland admin release and realize I need to file the 511.  Before I file the form 511, do I have to amend the 510s with all zeros?  Can I do the 510 amended via e-file?  My system is telling me not to file

the 511s.  What is the best way to proceed?  Thanks for your help.  The Maryland (revised) deadline is rapidly approaching!

Signed,

Confused & frustrated

From another listserve yesterday:

"The MACPA was told by the C’s Deputy Director that they are asking all PTE’s that filed the old 510 trying to make the entity election (instead of waiting for the 511) to “amend” by now filing the 511. Most of those 510s with election are likely wrong. HOWEVER, we were also told that in the expected-to-be rare case that the 510 tax calculation and related information to the members turned out to be exactly the same as what would show on the 511, the new 511 is not needed to be filed. TROUBLE is that there is no way for the C’s office to know whether the filed 510 produced the same calculation and info as a 511, and thus the expectation that the 511s will be filed. There is likelihood that the 510s with election that were processed (in error by C) will be pulled and reviewed and notices sent. So if there is any difference (and to the state, one dollar is a difference), it is best to amend by filing the 511, or else anticipate having to spend time with notices later."

Thanks for your input !

Three questions ...

Ok, you're confirming what I believe.  Now, do I have to re-file the 510 s I've already filed with zeros or just file the 511?  It sounds like I need to do both?

And my software is still showing the 511 in a DO NOT FILE status, which doesn't help me get anything done.  I take it we do not have a date on when the 511 form is available?

And, is e-filing still an option for 511 if we have already e-file the 510?

1. Probably both.

2. Is your software up to date? I thought all the software is supposedly efile ready for 511 now. (I don't use ProSeries).

3.I  don't know.

Sorry I'm not much help. The PTE tax and Form 511 are new this year. MD was terrible at getting out guidance and forms. The software cos. did not do a stellar job either.
