Instructions for this form say that unless LTC payment is on the basis of per diem contract, this form is not to be completed. Nevertheless, when there is ANY input for 1099-LTC in screen 32, Form 8853 is included in the tax return. If only one person receives a 1099-LTC, the form in included in the return and, if not for a per diem contract, no taxable income is reported. So...no harm, no foul.
BUG: if there more than one person receives a Form 1099-LTC, the program blocks efiling because IRS can't handle an efiled return with more than one Form 8853. Correct programming would prevent the form from printing and no blocking of efiling.
Thanks for the idea for the ability to e-file with more than one form 8853 or remove adding form 8853 when there's an input for 1099-LTC screen 32. We are changing the status to "Open for voting" since it is no longer considered "New".
