S-corp with a delay election 2553

Hi to all peer,

New client forgot to elect 2553 ( formed corp on 11/15/2023) and does not have any income for 2023. I filed 2553 with "FILED PURSUANT TO REV. PROC. 2013-30." along with 1120-S mail to the IRS where indicted on the instruction. Now my question is can I e-file State part?

Really appreciate any insight into my question!

You can try. I think it will depend on the state.

For future reference, it is possible to e-file the federal with that election being made

I called IRS they said should mail it along 2553.

Tax Guy Bill had a post last year pointing out that you can now attach a pdf of the 2553 and mark that you are making the late election and e-file the return.  I tried that route on a return earlier this tax season and it was accepted without any issues.  I have to give Bill 123 thumbs up for that post.

At that time when I called IRS they said should mail it . days ago I called them but again said should mail it.

You can not rely on tax advice given over the phone by IRS.
