EIN estate vs. irrevocable trust

suesayers
Level 3

Client died and at the request of a family member I applied for an EIN and marked it "estate."  Now the attorney says it is for an irrevocable trust and there might be a problem.  Is there a problem, and if so, how would I fix it?  Thanks in advance.

There can be both an estate and a trust.  In what capacity did your client ask for the application to be done?  As trustee, as executor or personal representative, or just as someone who sat next to the widow at the funeral?  In any case, if the trust needs its own number, the trustee can apply for one.
