ONE SPOUSE LIVES IN MD, ONE IN DE - FILED FEDERAL JOINT, CAN I FILE JOINT MD RETURN

I have a married couple - one lives in Maryland and one in Delaware.  The one in Delaware is retired with minimal income.  The one in Maryland has income > $100,000.  Can I file a joint Maryland return?  The one in Delaware is below the threshold.  Should I file a resident return for him in Delaware?  Thank you.

You have to check the rules in MD and DE. They will be stated in each state’s instructions.

If at first you don’t succeed…..find a workaround

I did.  It was unclear - I was hoping that someone else may have run into the same issue and had some guidance.  I spent over an hour trying to understand the instructions and, as you know, that is a lot of time to spend on something without being secure in your take-away.
