Looking for a recommendation on an issue I've never seen before. Client's Certificate of Formation filed with State of NJ has a different name than its SS-4. For example, Certificate of Formation Says ABC, LLP while the IRS 147C Letter says ABC Repair, LLP.
Seems like whoever obtained the Federal Tax ID number applied under the incorrect name.
This issue arose when the company's bank asked for a copy of the formation document.
How does one change the name at the IRS in an expedited fashion?
Or, does client seek a name change at the State level?
Any guidance is appreciated.
I believe NJ gave birth to this entity and the change should be at IRS. https://www.irs.gov/businesses/telephone-assistance-contacts-for-business-customers contact the first number for Entity Control.
It should then probably be up to the company to file a DBA with the (county?) as ABC, LLP Doing Business as ABC Repair, LLC. Locally it is called a Fictitious Name filing in my county.
All of this depends on what the client would want to do. If they really like ABC Repair, LLC they should probably then contact NJ https://www.njportal.com/dor/businessamendments
