If a tax preparer advises a client to file a 1099NEC and the client doesn't, is the tax preparer penalized?

No...  jail would be full of tax pro's if 'we' got into trouble every time a client failed to follow our advice.

But - I bet ya' there's more to this story.  Care to provide some context/details.

But remind the client that there could be a little box you have to check when preparing a return that might indicate they were supposed to file 1099s and didn't.

No, the taxpayer is ultimately responsible for what tax returns or informational returns he files,  which ones he does not file, what is included or not included on the ones he files, and what was not included on the ones he didn't file. This is just my opinion.
