A married taxpayer filed his 2022 tax return in error as single because his nonresident spouse doesn’t have SSN or ITIN. He wants to amend the return to change filing status to MFJ and file a tax return for 2023 as well.
Can he file both tax returns with Form W-7 by placing each tax return in its own envelope, then putting both envelopes into a larger envelope…Or is it better to file for current year with the W-7 then amend previous year after IRS issues spouse’s ITIN?
