Why is the wks. taxing the capital gain as ordinary income and 15%?

That's an open question, kinda like asking why do fools fall in love. But if the numbers aren't coming out the way you anticipated, it could be a case of pilot error. If not, you might want to provide some actual numbers and details to see if someone can help.
