Special needs trust.

Please let me know if a irrecocable special need trust is considered a fiducuary or an estate.

It is a trust that should file a fiduciary income tax return Form 1041. If you don't know you should not try to prepare the return.

Doesn't the name kinda give it away?  As a side note, someone has to be dead to have an estate.  If they are dead, they no longer have any special needs.
