Earned Income Credit for MFJ (TP & SP with SSN) when one child has SSN but the second one has ITIN

EIC (Earned Income Credit) for MFJ with TP, SP (both with SSN) and One Child with SSN but the Second child with ITIN

March 13, 2021

The Taxpayer and Spouse both have valid SSN and file MFJ, One child born in the USA has a SSN but the elder child has ITIN.

Except for SSN required for SSN for all the people on the 2020 Tax Return, the TP qualifies for EIC by fulfilling other EIC requirements.

The IRS Website states as follows:

To qualify for the EITC, everyone you claim on your taxes must have a valid Social Security number (SSN).

Pro Series Prof calculates EIC for one child with SSN.  Does the second child with ITIN not create a disqualification for EIC?

Any thoughts / clarifications / updates would be highly appreciated.

Thanks and Regards.

As someone with 80% Hispanic client base, they qualify as long as the taxpayer and spouse have socials valid for work purposes.

ProSeries is correct.

The IRS webpage oversimplified it.  Everyone you claim for EIC must have a SSN.

Thanks for your prompt reply.

But all I want to establish is that with one child with ITIN (despite TP, SP and another child with SSN), is EIC credit available calculated with only one child with SSN as done by the Pro Series Prof?

In another words, does one child with ITIN disqualify the entire EIC to these people and the calc by Pro Series is NOT correct to give EIC?
