    Do I have to mail the return for a deceased taxpayer if there is no surviving spouse?

    Who's getting the refund then?

    the executor of his estate, a lawyer established the estate, got a federal ID for it and appointed the executor in the will as the representative.  I added the form 1310 in the software, filled out the name as the decedent, the court appointed executor's info for the rest, chose B in Part 1, answered YES to leave a will, yes to 2a and yes to 3. I keep getting a critical error that says I have to mail the return.

    As the instructions to Form 1310 tell you, it's not required.  Buit the people who write the forms obviously don't talk to the people who write the e-filing requirements.
