I have individual with North Dakota (nonresident) with carryover of passive losses from North Dakota property that were deducted again from their current year's North Dakota income. This differs from his federal return. North Dakota is disallowing the passive loss against the current year's income.
This doesn't seem correct to me. Can someone provide me with some guidance on this? Much appreciated.
