For reference, the IRS won't be making a determination for MA. MA has noted it will follow Fed treatment. FMLA is the same as UI. You might recall that last year Congress passed an exclusion on UI for the first $10,200. MA would follow the IRS, if and when the Congress made/makes a retroactive exclusion like that, again. Right now, there is no such exclusion.
