I sent a paper S Corp return with late election 2 months ago. I know it’s going to be ages (hopefully just months) until I hear form IRS. (C Corp electing S Corp)
Now I need to file a late CA return. What is the best option:
- File a C Copr return, amend when I receive S Corp approval form IRS (probably the legit way, but darn long and complicated)
- Mail a S Corp return, hoping that by the time they get to it I will be a legit S Copr with IRS
- Wait (and pay penalties for late filing) for IRS approval and send a S Corp return after IRS approves the status
I know you are going to make me feel bad for asking such a dumb question (always happens), so hit me with your contempt but please answer the question 😊

I vote for
"Mail a S Corp return, hoping that by the time they get to it I will be a legit S Copr with IRS"

I don't even know what contempt means, so why did I get dragged into this?😉

I won't be in this field if I won’t be able to take the use and abuse (e.g. disgruntled customers, blaming the preparer for their liability, anybody?).
