Hi,
One of my client moved back to India in dec 2023. However he had some RSU' in 2023 and vested in 2024 . Now he got a W2 from his previous company for the tax paid for this RSU's (Almost 200k income and 20k in tax). He is Non resident of US and resident of India since 01/01/2024. I think i have to file 1040NR for him. He is married and 2 kids. Can i file MFJ in 1040 NR? He is asking whether he will get full refund bcos he is nonresident in 2024. Pls reply

Yes he must file a 1040NR, because of receiving a W2 he is considered engaged in a business in US. He may be covered by a treaty with India, but you will have to research that.

Is he a US citizen or Green Card holder?
