How to resolve ProConnect Tax diagnostic Ref 40376 Invalid setup: Form 114 for the spouse

This article will help resolve the following e-file critical diagnostic:

  • e-file: Invalid Setup: Form 114 for the Spouse had been selected for Electronic Filing but there is no Form 114 for the spouse in the return. Please double check your entries. (ref. #40376)

This diagnostic will generate if the Federal Form 114 (Spouse) is selected for e-file on the Profile tab, but there's no foreign account marked Spouse.

If the taxpayer and spouse jointly owned a foreign account, both spouses are required to file separate FBARs, and each spouse must report the entire value of the jointly owned accounts unless one of the exception conditions apply.

Solution #1: Marking the account as Spouse

  1. From the Input Return tab, go to Miscellaneous Forms Foreign Reporting (114, 8938).
  2. Select Foreign Bank Account (Form 114).
  3. Click on the blue Account hyperlink in the upper right corner of this input screen.
  4. Check the box labeled Spouse in any account(s) that are applicable for the spouse rather than the taxpayer.

Solution #2: Spouse doesn't have a foreign bank account

  1. Go to the Profile tab.
  2. Uncheck the box under SELECT FOR E-FILE next to Federal Form 114 (Spouse).

Solution #3: Account is owned jointly and the 114 is not being amended

  1. From the Input Return tab, go to Miscellaneous Forms Foreign Reporting (114, 8938).
  2. Select Foreign Bank Account (Form 114).
  3. Delete any entries in Spouse Bank Security Act ID (BSA ID).
