It may be tempting to classify an employee as an independent contractor because of the cost savings, but don\u2019t do it! There are strict rules surrounding the proper classification of a worker and steep penalties for failure to apply the law properly.<\/span><\/p>\n<p><span style=\"font-weight:400;\">If you answer \u201cyes\u201d to any of the following questions, you\u2019re likely hiring a W-2 employee and not a 1099 independent contractor:<\/span><\/p>\n<ul>\n<li style=\"font-weight:400;\"><span style=\"font-weight:400;\">Will the work be performed on company premises?<\/span><\/li>\n<li style=\"font-weight:400;\"><span style=\"font-weight:400;\">Will the individual work only for you?<\/span><\/li>\n<li style=\"font-weight:400;\"><span style=\"font-weight:400;\">Will you provide tools and training for your worker?<\/span><\/li>\n<li style=\"font-weight:400;\"><span style=\"font-weight:400;\">Do you control the hours the person works?<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight:400;\">Use <\/span><a href=\"http:\/\/payroll.intuit.com\/resources\/hiring\/1099-or-W2\"><span style=\"font-weight:400;\">this infographic<\/span><\/a><span style=\"font-weight:400;\"> to help you distinguish between the two.<\/span><\/p>\n<p><span style=\"font-weight:400;\">Form 1099-MISC is required if you\u2019ve paid $600 or more for services performed for your business by people not treated as your employees. Those payments can include fees to subcontractors, attorneys or accountants. The form must be sent to recipients by January 31 and to the IRS by Feb. 28, or March 31 if filing electronically. There are convenient electronic services, such as Intuit\u2019s\u00ae <\/span><a href=\"http:\/\/payroll.intuit.com\/additional-services\/1099\" data-wa-link=\"body_payroll-1099infogr\"><span style=\"font-weight:400;\">1099 e-file<\/span><\/a><span style=\"font-weight:400;\">, that pre-fill your information and enable you to email or print forms for your contractors so that you don\u2019t have to run to the office supply store to buy them.<\/span><\/p>\n<p><span style=\"font-weight:400;\">You must file the Form W-2 Wage and Tax Statement to report payments to your employees, such as wages, tips and other compensation.
