{"id":2312,"date":"2016-07-14T07:00:53","date_gmt":"2016-07-14T12:00:53","guid":{"rendered":"https:\/\/taxprocenter.proconnect.intuit.com\/?p=2312"},"modified":"2021-05-18T11:52:28","modified_gmt":"2021-05-18T16:52:28","slug":"how-audits-are-conducted-by-the-irs","status":"publish","type":"post","link":"https:\/\/accountants.intuit.com\/taxprocenter\/tax-law-and-news\/how-audits-are-conducted-by-the-irs\/","title":{"rendered":"How Audits Are Conducted by the IRS"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">If you\u2019ve helped an individual or business client prepare for an audit, then you probably have played the roles of friend, nursemaid and psychiatrist, but more than anything else, you\u2019ve used your knowledge of tax and the IRS to ensure your client understands many of the somewhat-complicated components associated with an audit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Whether you have this experience or have yet to navigate the audit process for a client, here\u2019s a primer on how audits are conducted the IRS:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An IRS audit is a review or an examination of a taxpayer\u2019s accounts and financial information, in order to verify that information is properly being reported, tax laws are being followed and the amount of tax reported is substantially accurate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tax returns are selected for audit by the IRS using the following three methods (an audit does not necessarily suggest an error has been made):<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><b>Random selection and computer screening:<\/b><span style=\"font-weight: 400;\"> sometimes, returns are selected based solely on a statistical formula.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Document matching:<\/b><span style=\"font-weight: 400;\"> occurs when payer records, such as Forms W-2 or Form 1099, do not match the information reported.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Related examinations:<\/b><span style=\"font-weight: 400;\"> returns may be selected for audit when they involve issues or transactions with other taxpayers, such as business partners or investors, whose returns were selected for audit.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">An audit may be conducted by mail, or through an in-person interview and review of the taxpayer\u2019s records. The interview may either take place at an IRS office (office audit), or the taxpayer\u2019s home, place of business or accountant\u2019s office (field audit). The IRS will notify you about an audit by mail or telephone, and will indicate the records that are needed. A letter from the IRS will follow a telephone contact, and the IRS does not notify via email.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Taxpayer\u2019s rights during an audit include the following:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A right to professional and courteous treatment by IRS employees.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A right to privacy and confidentiality about tax matters.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A right to know why the IRS is asking for information, how the IRS will use it and what will happen if the requested information is not provided.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A right to representation, by oneself or an authorized representative.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A right to appeal disagreements, both within the IRS and before the courts.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The right to pay no more than the correct amount of tax.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">An audit can be determined, and concluded, in the following three ways:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><b>No change:<\/b><span style=\"font-weight: 400;\"> taxpayer has substantiated all items being reviewed.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Agreed:<\/b><span style=\"font-weight: 400;\"> taxpayer understands and agrees to the changes proposed by the IRS.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Disagreed:<\/b><span style=\"font-weight: 400;\"> taxpayer understands and disagrees to the changes proposed by the IRS: A conference with a manager may be requested for further review, and <\/span><a href=\"https:\/\/www.irs.gov\/individuals\/appeals-mediation-programs\" data-wa-link=\"body_irs-mediation\" target=\"_blank\"><span style=\"font-weight: 400;\">Appeals Mediation Programs<\/span><\/a><span style=\"font-weight: 400;\"> are available, or an <\/span><a href=\"https:\/\/www.irs.gov\/individuals\/appeals-resolving-tax-disputes\" data-wa-link=\"body_resolving-disputes\" target=\"_blank\"><span style=\"font-weight: 400;\">Appeal<\/span><\/a><span style=\"font-weight: 400;\"> request may be filed.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Here is a diagram from the IRS that illustrates the audit process:<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" size-full wp-image-2316 aligncenter\" src=\"https:\/\/taxprocenter.proconnect.intuit.com\/wp-content\/uploads\/2016\/07\/audit-process.png\" alt=\"Audit process.png\" width=\"673\" height=\"539\" srcset=\"https:\/\/taxprocenter.proconnect.intuit.com\/wp-content\/uploads\/2016\/07\/audit-process.png 673w, https:\/\/taxprocenter.proconnect.intuit.com\/wp-content\/uploads\/2016\/07\/audit-process.png?resize=150,120 150w, https:\/\/taxprocenter.proconnect.intuit.com\/wp-content\/uploads\/2016\/07\/audit-process.png?resize=300,240 300w\" sizes=\"auto, (max-width: 673px) 100vw, 673px\" \/><\/p>\n<p><b>Audit Assistance and ID Theft Restoration<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Intuit<\/span><span style=\"font-weight: 400;\">\u00ae<\/span><span style=\"font-weight: 400;\"> has partnered with Tax Protection Plus to offer an <\/span><a href=\"https:\/\/taxpro.intuit.com\/client-benefit-suite\/#AuditAssistance\" data-wa-link=\"body_cbs-aa\"><span style=\"font-weight: 400;\">Audit Assistance and ID Theft Restoration<\/span><\/a><span style=\"font-weight: 400;\"> service.
