{"id":11255,"date":"2025-10-20T08:02:00","date_gmt":"2025-10-20T13:02:00","guid":{"rendered":"http:\/\/taxprocenter.proconnect.intuit.com\/?p=11255"},"modified":"2025-10-20T12:29:21","modified_gmt":"2025-10-20T17:29:21","slug":"engagement-letter-best-practices-for-tax-pros","status":"publish","type":"post","link":"https:\/\/accountants.intuit.com\/taxprocenter\/practice-management\/engagement-letter-best-practices-for-tax-pros\/","title":{"rendered":"Engagement letter best practices for tax pros"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Although engagement letters are a base requirement for the preparation of all tax returns, these letters also walk a fine line. Good ones are a balance between providing enough information and clarity to the tax client about the services you are providing, but not so detailed that the client is scared off by the length of the letter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is also an element of tone to the letter. The letter should assume that the client is honest, but it needs to protect you if the client is questionable. Of course, if honesty is not part of the relationship, would you have the client at all?<\/p>\n\n\n\n<p class=\"has-x-large-font-size wp-block-paragraph\"><strong>First, the basics<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The engagement letter must address additional work if needed. For example, is additional bookkeeping required because the client\u2019s books are provided in a haphazard manner? This may be due to an unusual transaction, such as the sale of a rental property, which calls for additional computational work. The engagement letter can address this by stating additional work will be discussed with the client prior to starting work. <a href=\"https:\/\/taxprocenter.proconnect.intuit.com\/advisory-services\/accurately-pricing-your-advisory-services\/\">Price<\/a> and delivery time should also be spelled out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Part of a new tax client engagement is to request prior year tax returns. This may be one year or more depending on a variety of factors, including the complexity of the tax work and type of activities on the returns. Discussion of findings should be addressed, as well as the action that should be taken.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/taxprocenter.proconnect.intuit.com\/tax-law-and-news\/pass-through-entity-taxation-for-business-growth\/\">Business tax returns<\/a> for corporations, partnerships, and limited liability companies require a few additional considerations. Business returns may have better accounting as support for the tax return preparation, but regardless of what is provided to you, the supporting work must be reviewed prior to starting the tax return. The engagement letter for business entities should contemplate all additional steps needed to do a quality job. You should also have some <a href=\"http:\/\/proconnect.intuit.com\/taxprocenter\/practice-management\/3-ways-to-gain-high-quality-clients\/\">experience<\/a> in the client\u2019s industry or business to do a good job. For example, if you have no experience in construction, then you should not be taking on the tax preparation work for such a business.<\/p>\n\n\n\n<p class=\"has-x-large-font-size wp-block-paragraph\"><strong>What&#8217;s included in your engagement letter<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unless you\u2019re new to the profession, you probably have examples of letters you\u2019ve already prepared. That\u2019s great, but make sure you cover your bases. These include the following elements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The scope of work is clearly identified\u2013for example, \u201cPreparation of 2025 federal and state personal income tax returns.\u201d<\/li>\n\n\n\n<li><a href=\"http:\/\/proconnect.intuit.com\/taxprocenter\/practice-management\/how-do-your-tax-preparation-fees-stack-up\">Fee structure<\/a> for the scope of the work.<\/li>\n\n\n\n<li>Source of the information, prepared from documents the client provides.<\/li>\n\n\n\n<li>Use of an organizer, which may have prior year information.<\/li>\n\n\n\n<li>Timing to complete the engagement.<\/li>\n\n\n\n<li>What happens if all information is not received within ample time before the due date to allow for timely preparation.<\/li>\n\n\n\n<li>Requirement to file electronically under most circumstances, which is becoming the requirement for many tax agencies.<\/li>\n\n\n\n<li>The manner in which difficult issues will be managed and reviewed with the client. Make sure that a memo is prepared to state the outcome of the issue and placed in the tax file.<\/li>\n\n\n\n<li>Highlight any higher visibility issues, such as foreign income, underpaying estimates, under reporting or non-reporting of income and overall status of prior year taxes of any and all kinds.<\/li>\n\n\n\n<li>How examinations and\/or <a href=\"http:\/\/proconnect.intuit.com\/taxprocenter\/tax-law-and-news\/6-tips-for-clients-if-they-receive-a-notice-from-the-irs\/\">tax authority letters<\/a> will be handled with regard to fee structure, timing and method to resolve.<\/li>\n\n\n\n<li>Any discussion of additional services after the tax return is prepared.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-x-large-font-size wp-block-paragraph\"><strong>Special conditions<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you work with clients in the <a href=\"https:\/\/accountants.intuit.com\/taxprocenter\/tax-law-and-news\/accounting-for-cannabis-grow-your-niche-within-the-accounting-industry\/\">cannabis<\/a> industry, you\u2019ll also want to consider the following points for your engagement letters:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Have a discussion of the fact that, federally, any business in the cannabis industry is illegal and how to report income taxes for the same period for a state which has legalized cannabis.<\/li>\n\n\n\n<li>Our firm only provides services to legally operated businesses. In light of the first point above, the business must be in the process of obtaining, have, or maintain proper licensing at the local and state levels.\u00a0<\/li>\n\n\n\n<li>If the business is ever out of compliance regarding the second point above, the company must immediately (within 24 hours of notification of non-compliance) notify our firm, and is subject to immediate termination of our engagement.<\/li>\n\n\n\n<li>Tax rates are so high that the number of clients with unpaid taxes warrants\u00a0 the letter to be narrowed in scope to only cover the preparation of the tax returns.\u00a0 All work associated with communication between tax agencies following tax preparation to be set up as a separate engagement letter.<\/li>\n\n\n\n<li>If certain provisions of the IRC are incorporated for the first time on a return, additional time will be required to document and report the changes on the tax return.<\/li>\n\n\n\n<li>Always state that a deposit is taken at the time of the signing of the engagement.<\/li>\n\n\n\n<li>Short terms for payment are included.<\/li>\n\n\n\n<li>State that the deposit is not used to pay for current services, but remains on the account until the engagement is terminated or completed.<\/li>\n\n\n\n<li>Billings should not exceed the value of the deposit, so the firm is never out of pocket for money.<\/li>\n\n\n\n<li>Notification that if payments are by cash and aggregate more than $10,000 in a year , the firm will file <a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8300.pdf\" target=\"_blank\">Form 8300<\/a>, <em>Report of Cash Payments Over $10,000 Received in a Trade or Business,<\/em> to reflect cash received.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">The field of tax is very exciting and fulfilling, but to enjoy your work, it\u2019s very important that your clients understand their relationship with you and the expectation of the work to be performed.
