1099-R Equal Periodic Payments

My client received a 1099-R with codes 1,D. Distribution was used for higher ed. My client was told that the 10% penalty would be waived if the distribution were part of Equal Periodic Payments, but that appears to be incorrect.  I just want to verify with the experts before I file the return.

did you fill out form 5329 for exemption to 10% penalty code 02 is the code for equal periodic payments and code 08 is higher education costs
