husband 70 wife 57 pro series is giving them eic  i thought both had to be under 65

Nope.  Just one (for the EIC without child).  Although I remember one year IRS sent out incorrect notices disallowing it in cases like that, and we had to call them to fix it.  That was back when they answered the phone.
