Solved

Taking the pre-tax daycare exclusion, (not the credit) on a married, filing separate return; however, Lacerte gives me a critical diagnostic. Is there a work around?

Did you enter the expenses for the credit? If not the pretax becomes taxed.

Enter all the information so that the 2441 properly computes and the PreTax shows up on the 2441 so that you don't get either the credit or the income.

For full and complete explanation, read the instructions for the 2441.

Thanks George4Tacks for your input.  I did complete the form correctly and there is no credit or income; however, Lacerte gives me critical diagnostic that I cannot file Form 2441 on a married, filing separate return unless I check the box "considered unmarried."  (which is not valid)
